Alle inhoud op deze website van DUTCH FILMWORKS (de “Site”), waaronder maar niet beperkt tot audiovisuele en cinematografische werken, redactionele teksten, commentaren, illustraties, foto’s, afbeeldingen, geluiden, video’s en andere elementen (de “Inhoud”), is beschermd door intellectuele eigendomsrechten. Gebruik van deze Inhoud zonder voorafgaande schriftelijke toestemming van DUTCH FILMWORKS is niet toegestaan.

Overeenkomstig § 15o Auteurswet, ter implementatie van artikel 4 van Richtlijn (EU) 2019/790, maakt DUTCH FILMWORKS uitdrukkelijk bezwaar tegen elke vorm van tekst- en datamining (TDM) van de Inhoud door geautomatiseerde systemen, waaronder toepassingen van kunstmatige intelligentie, ongeacht het doel (commercieel of niet-commercieel).

Elke tekst- en dataminingoperatie door een kunstmatig intelligentiesysteem die gebruikmaakt van de Inhoud en/of onderdelen daarvan die door auteursrecht worden beschermd (zoals tekst, grafische elementen, tekens, signalen, geluiden, afbeeldingen, enz.) en die op de Site worden gepresenteerd of openbaar beschikbaar zijn, vormt een inbreuk en is onderworpen aan de sancties zoals voorzien in § 27 Aw en § 27a Aw, tenzij vooraf schriftelijke toestemming is verkregen van DUTCH FILMWORKS.

Om dit bezwaar machineleesbaar te maken, wordt het ook uitgedrukt als: <TDM-RESERVATION: 1> of TDM: NO.

Dit bezwaar geldt tevens voor elk gebruik van kunstmatige intelligentie of enig ander geautomatiseerd proces met het doel om:
(i) de Inhoud en informatie van de Site (of verkregen via de Site) te archiveren, reproduceren,
distribueren, wijzigen, weergeven, uitvoeren, publiceren, licentiëren, afgeleide werken te
creëren, verkopen of anderszins te exploiteren;
(ii) beschermingsmaatregelen of andere elementen van de Site, waaronder de grafische
gebruikersinterface, advertenties, auteursrechtvermeldingen en handelsmerken, te omzeilen,
verwijderen, wijzigen, uitschakelen, vernietigen, blokkeren of verbergen;
(iii) robots, crawlers, webscrapingtools of andere geautomatiseerde methoden te gebruiken om
toegang te krijgen tot de Site;
(iv) de inhoud van de Site op enigerlei wijze te manipuleren, inclusief met het doel om nepnieuws
of desinformatie te genereren;
(v) enige methode van datamining, verzameling of extractie toe te passen;
(vi) inhoud te uploaden of te verzenden op enige wijze die bedoeld is om de Site te schaden, te
beperken of te vernietigen, inclusief via virussen of enige andere code, bestand of
computerprogramma.

All content, including but not limited to audiovisual and cinematographic works, editorial content, commentary, illustrations, photos, images, sounds and videos and other elements (the “Content”) available on the DUTCH FILMWORKS website (the “Site”), including its structure, is protected by intellectual property rights and may not be used without the prior written authorization of DUTCH FILMWORKS.

In accordance with § 15o Aw (Dutch Copyright Act), transposing § 4 of the Directive (EU) 2019/790, DUTCH FILMWORKS expressly objects to any text and data mining (TDM) of its Content by automated systems, including artificial intelligence tools, regardless of the purpose (commercial or non-commercial).

As a result, any text and data mining operation by an artificial intelligence system using the Content and/or any of its components protected by copyright (text, graphics, signs, signals, sounds, images, etc.) presented or made available to the public on the Site constitutes an act of infringement and is subject to the penalties provided for under § 27 Aw and § 27a Aw (Dutch Copyright Act), unless prior written authorization has been obtained from DUTCH FILMWORKS.

To ensure this objection is machine-readable, it is also expressed as: <TDM-RESERVATION: 1> or TDM: NO.

It is further specified that this objection also applies to the use of an artificial intelligence system and, more generally, to any device or process for the purpose of:
(i) archiving, reproducing, distributing, modifying, displaying, performing, publishing, licensing,
creating derivative works from, selling, or otherwise using the Content and information from the
Site (or obtained through it);
(ii) circumventing, removing, altering, disabling, destroying, blocking, or obscuring content
protections or other elements of the Site, including the graphical user interface,
advertisements or advertising elements, copyright notices, and trademarks;
(iii) using robots, crawlers, web scraping tools, or other automated methods to access the Site;
(iv) manipulating the Site’s content in any way, including for the purpose of generating fake news
or misinformation;
(v) using any method of data mining, collection, or extraction;
(vi) uploading or transmitting any content in any way intended to harm, restrict, or destroy the Site,
including through viruses or any other code, file, or computer program.
